«Yourhodl Corporate Limited» provides services and related content to you through the website located at https://yourhodl.com/ (the “Site”) and through mobile applications and related technology (“Mobile Applications,” and collectively, such Mobile Applications and the Site, including any updated or new features, functionality and technology, the “Services”). Any access to and use of the services is subject to the terms and conditions contained in these Terms of Service (as amended from time to time, these “Terms of Service”). By accessing, browsing, or otherwise using the Site, Mobile Applications, or any other aspect of the services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not accept the terms of these Terms of Service, you will not access, view, or otherwise use the services.
In our sole discretion, we reserve the right to change these Terms of Service at any time. In that case, you agree to these Terms of Service for that entity or organization and represent to YOURHODL that you have the authority to bind that entity or organization to these Terms of Service (in which case, the term “you” will refer to that entity or organization).
PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN THE ARBITRATION AGREEMENT AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THE ARBITRATION AGREEMENT REQUIRES (WITH LIMITED EXCEPTIONS) THAT YOU SUBMIT YOUR CLAIMS TO US FOR BINDING AND FINAL ARBITRATION, AND, IN ADDITION, (1) YOU WILL BE PERMITTED TO PURSUE YOUR CLAIMS AGAINST YOURHODL ONLY INDIVIDUALLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, (2) YOU WILL BE PERMITTED TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE AND DECLARATORY RELIEF) ONLY INDIVIDUALLY, AND (3) YOU MAY NOT BE ABLE TO SEEK RELIEF (INCLUDING MONETARY, INJUNCTIVE AND DECLARATORY RELIEF) IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING, (4) YOU MAY NOT BE PERMITTED TO PURSUE YOUR CLAIMS AGAINST YOURHODL.

By using the services, you consent to our collection, use, and disclosure of personal information and other data, as the Privacy Policy outlines.
Additional Terms: Certain services may be subject to additional terms and conditions published or made available separately from these Terms of Service (“Additional Terms”). Your use of the services may also be subject to additional policies, guidelines, or rules we publish or make available. Such Additional Terms, policies, procedures, and regulations are incorporated into and form an integral part of these Terms of Service. In the event of a conflict between these Terms of Service and the Additional Terms, the Additional Terms will prevail. An example of Additional Terms is your credit agreement (as described below).
Access to and use of the Service
Loans: The services may include loans (each a “Loan”) provided by YOURHODL. You may be eligible for a loan under the loan agreement you enter into with us when you borrow from YOURHODL (the “Loan Agreement”) for use for any lawful personal, family, household, or business purpose. YOURHODL’s activities are primarily in compliance with laws and regulations.
Registration and Identity Verification Obligations: You may be required to register with YOURHODL or provide information about yourself (such as your name and email address) to access and use certain features of the services. If you register to access the services, you agree to provide and maintain true, accurate, current, and complete information about yourself by the Service’s registration forms. Our Privacy Policy governs registration information and certain other information about you.
We will collect and verify your personal and financial information. We may also receive third-party personal information to verify your identity or prevent fraud. Personal information obtained from any source may include but is not limited to, your name and address, social security or tax identification number, and date of birth. You now authorize us or our designated third-party service provider to take any action necessary to validate the personal information you provide, verify and authenticate your personal information, and take any action we deem necessary based on the results.
If you are under 18, you can’t use the services with or without registration.
Member Account, Password, and Security: You are responsible for maintaining the confidentiality of your password and account information, if any, and are solely responsible for any activities under your password or account. You agree to (a) immediately notify YOURHODL of any unauthorized use of your password or account or any other breach of security and (b) ensure that you log out of your account at the end of each session when accessing the services. YOURHODL will not be liable for any loss or damage arising from your failure to comply with this clause.
Changes to the Services: YOURHODL reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that YOURHODL will not be liable to you or any third party for any modification, suspension, or discontinuance of the services.
General Use and Storage Rules: YOURHODL establishes general rules and restrictions regarding the use of the services, including the maximum period that YOURHODL or its third-party service providers store data or other content on the services and the maximum storage space allocated by YOURHODL or its third-party service providers (servers) on your behalf, which you acknowledge. You agree that YOURHODL has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded by the services. You acknowledge that YOURHODL reserves the right to terminate inactive accounts for an extended period. You further acknowledge that YOURHODL reserves the right to change these general practices and restrictions at any time, in its sole discretion, with or without notice.
Conditions of access and use
User Conduct: You are solely responsible for all code, video, images, information, data, text, software, music, sound, photographs, graphics, messages, and other materials (“content”) that you provide to YOURHODL, including by uploading, posting, making public or displaying (“uploading (editing)”) via the services, sending emails, or otherwise providing access to other users of the services (collectively, “User Content”). The following are examples of the types of content and uses that are illegal or prohibited by YOURHODL. YOURHODL reserves the right to investigate and take appropriate legal action against anyone who, in YOURHODL’s sole discretion, violates this provision, including removing offensive content from the services, suspending or terminating the account of such violators, and reporting the violator to law enforcement authorities.
You agree not to use the Services to:
Emailing or otherwise sending or uploading any content that infringes the intellectual property or other proprietary rights of any party; you are not authorized to upload it under any law or a contractual or fiduciary relationship; containing software viruses, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware and interfere with or disrupt the services, servers, or networks connected to the services, or violate any requirements, procedures, policies, or regulations of the networks connected to the services.
